1. Agreement to Terms
By accessing and using the Regal Roams Safari website and services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our services.
2. Services Description
Regal Roams Safari provides luxury safari booking and tour operator services across East and Southern Africa. Our services include but are not limited to:
- Safari tour planning and coordination
- Accommodation bookings at partner lodges and camps
- Professional safari guide services
- Ground transportation arrangements
- Activity coordination (game drives, gorilla trekking, cultural visits)
- Travel consultation and itinerary design
3. Booking and Payment
3.1 Booking Process
All bookings are subject to availability and confirmation. A booking is confirmed only upon receipt of the required deposit and our written confirmation.
3.2 Payment Terms
- Deposit: A non-refundable deposit of 30% is required to secure your booking
- Balance Payment: Full payment must be received at least 60 days before the safari start date
- Late Bookings: Bookings made within 60 days of departure require full payment at time of booking
- Accepted Payment Methods: Bank transfer, credit card, and other methods as specified
3.3 Pricing
All prices are quoted in USD unless otherwise stated. Prices are subject to change until booking is confirmed with deposit payment. We reserve the right to adjust prices in case of significant currency fluctuations, fuel surcharges, or changes in park fees.
4. Cancellation and Refund Policy
4.1 Cancellation by Client
- More than 90 days before departure: Deposit forfeited, remaining balance refunded
- 60-90 days before departure: 50% of total cost forfeited
- 30-59 days before departure: 75% of total cost forfeited
- Less than 30 days before departure: 100% of total cost forfeited (no refund)
4.2 Cancellation by Regal Roams
We reserve the right to cancel a safari due to insufficient bookings, safety concerns, or circumstances beyond our control. In such cases, you will receive a full refund or the option to reschedule.
4.3 Changes and Amendments
Any changes to confirmed bookings are subject to availability and may incur amendment fees plus any additional costs from suppliers.
5. Travel Documents and Requirements
You are responsible for ensuring that you have:
- Valid passport (with at least 6 months validity from return date)
- Required visas for all countries visited
- Necessary vaccinations and health certificates (e.g., yellow fever)
- Appropriate travel and medical insurance
We are not liable for any consequences resulting from failure to obtain proper documentation.
6. Travel Insurance
Travel insurance is mandatory for all safari participants. Your insurance policy should cover:
- Medical expenses and emergency evacuation
- Trip cancellation and interruption
- Lost or delayed baggage
- Personal liability
- Adventure activities (if applicable)
You must provide proof of insurance before the safari start date.
7. Health and Safety
Safari activities involve inherent risks. By participating, you acknowledge and accept these risks. You must:
- Disclose any medical conditions or special requirements at time of booking
- Follow all safety instructions from guides and staff
- Maintain appropriate physical fitness for planned activities
- Carry prescribed medications in original containers
We reserve the right to refuse participation if your health or behavior poses risk to yourself or others.
8. Liability and Disclaimer
Regal Roams Safari acts as an agent in arranging accommodations, transportation, and activities. We are not liable for:
- Acts of third-party service providers (lodges, airlines, etc.)
- Injuries, illness, or death resulting from safari activities
- Loss or damage to personal property
- Delays or changes due to weather, wildlife behavior, or force majeure
- Failure to see specific wildlife (sightings cannot be guaranteed)
Our liability is limited to the value of the services purchased and we recommend comprehensive travel insurance.
9. Conduct and Behavior
Guests are expected to:
- Respect local cultures, customs, and wildlife
- Follow park rules and conservation guidelines
- Treat guides, staff, and fellow travelers with courtesy
- Avoid behavior that endangers wildlife or disrupts the experience of others
We reserve the right to remove guests who engage in inappropriate conduct, without refund.
10. Photography and Media
By participating in our safaris, you consent to being photographed or filmed for promotional purposes unless you notify us in writing. You retain copyright to your own photos but grant us permission to use them with appropriate credit if shared with us.
11. Force Majeure
We are not liable for failure to perform services due to circumstances beyond our control, including but not limited to: natural disasters, war, terrorism, epidemics, government restrictions, strikes, or infrastructure failures.
12. Dispute Resolution
Any disputes arising from these terms will be resolved through good faith negotiation. If resolution cannot be reached, disputes will be subject to the jurisdiction of Kenya courts.
13. Data Protection
Your personal information is collected and used in accordance with our Privacy Policy. By using our services, you consent to such collection and use.
14. Amendments
We reserve the right to modify these Terms and Conditions at any time. Changes will be effective upon posting to our website. Continued use of our services constitutes acceptance of modified terms.
